Legal and procedural support for the realization of land ownership in Ukraine

Abstract

Finding a national model for economic circulation of agricultural land used for agricultural commodity farming has become one of the major challenges in addressing violations of constitutional requirements for securing the inviolability of private land ownership, in particular for depriving it of the right to dispose of it. The moratorium, introduced since January 1, 2002, has become a serious impediment to the consolidation of land use, increase of its level of investment attractiveness, as well as to the increase of the efficiency of land use, and implementation by the state of its functions regarding special protection of the land fund as the major national wealth. The article deals with the historical aspects of the formation of private property in modern conditions, the problems of legislative regulation of the ban on the transfer of agricultural land to foreign individuals and legal entities, the holding of an all-Ukrainian referendum on the sale of agricultural land.
